Four Nebraska Rules and Programs Worth Knowing

Medicare is federal, but the rules and assistance programs around it change at the state line. These four are specific to Nebraska, and your advocate works with them every week.

Medigap: a new under-65 right, capped at 150% of the age-65 rate

Your six-month Medigap Open Enrollment Period begins the first month you are both 65 or older and enrolled in Part B. Nebraska has no birthday rule and no year-round switching, so that window matters. What changed recently: under LB 852, effective January 1, 2025, any insurer selling Medicare Supplement plans to people 65 and older must also offer coverage to beneficiaries who qualify for Medicare under 65 through disability, with the same six-month window, no underwriting during it, and a premium no higher than 150% of the age-65 rate. Only Plan A is guaranteed under 65, and people with End-Stage Renal Disease are not eligible before 65; a full open-enrollment window for every plan then opens at 65. Getting the timing right is exactly where an advocate earns their keep.

Nebraska SHIP: free state Medicare counseling in all 93 counties

Nebraska's State Health Insurance Assistance Program is Nebraska SHIP, and it is a division of the Nebraska Department of Insurance, offering trained, commission-free counseling statewide (the same office runs the Senior Medicare Patrol). Statewide helpline: 1-800-234-7119. Counselors take no commissions and sell nothing. Great for one-off enrollment questions; we point our own members there during Open Enrollment.

Extra Help and the Medicare Savings Programs

Nebraska does not run its own state prescription-assistance program, so the drug-cost help here is federal: many Nebraskans qualify for Extra Help (the Part D Low-Income Subsidy) but never enroll. On top of that, the Nebraska DHHS Division of Medicaid & Long-Term Care runs the Medicare Savings Programs as QMB, SLMB, and QI to help cover Part B premiums and cost-sharing. Apply through iServe Nebraska (formerly ACCESSNebraska) at 1-855-632-7633 or online at iserve.nebraska.gov, and enrolling in an MSP automatically triggers Part D Extra Help. Screening for every one of these is standard advocate work, and most eligible seniors never claim them.

The Aged and Disabled Waiver, paid family caregiving, and PACE (Medicaid)

Nebraska's Medicaid alternative to a nursing facility is the HCBS Aged and Disabled (AD) Waiver, which helps Nebraskans 65 and older (and adults with disabilities) who meet a nursing-facility level of care stay home with in-home support, administered by the Nebraska DHHS Division of Medicaid & Long-Term Care. Its AD Independent Provider option lets you hire and supervise your own worker, including a family member such as an adult child; a spouse or parent can be paid only through LRI Personal Care and only when the care meets an "Extraordinary Care" standard. PACE (Program of All-Inclusive Care for the Elderly) bundles all care for adults 55 and older who need a nursing-facility level of care, and in Nebraska it is offered by Immanuel Pathways in Omaha, serving Douglas and Sarpy counties. Nebraska expanded Medicaid in 2020 (the Heritage Health Adult population), so more Nebraskans qualify than before; for dual-eligible families we handle the Medicare side while you run the caregiving.
