Four New Jersey Rules and Programs Worth Knowing

Medicare is federal, but the rules and assistance programs around it change at the state line. These four are specific to New Jersey, and your advocate works with them every week.

Medigap: your one clean window is at 65, with a strong under-65 disability protection

New Jersey has no Medigap birthday rule and no annual guaranteed-issue window for people 65 and older, so the federal rules govern: your one guaranteed six-month Medigap Open Enrollment Period begins when you are 65 and enrolled in Part B, and once it closes an insurer can medically underwrite you, raising your rate or declining you, outside a few narrow federal guaranteed-issue situations. New Jersey does add a protection many states lack for younger beneficiaries: under rules the New Jersey Department of Banking and Insurance (DOBI) enforces, at least one carrier must offer a Medigap plan on a guaranteed-issue basis to people under 65 who have Medicare because of a disability or ESRD, and it must charge them the same premium it charges a 65-year-old, if they apply within 12 months of enrolling in Part B. Because there is no yearly reset for those 65 and older, getting the timing right the first time is exactly where an advocate earns their keep.

SHIP: free state Medicare counseling in all 21 counties

New Jersey's State Health Insurance Assistance Program, known simply as SHIP, is delivered free through the New Jersey Department of Human Services, Division of Aging Services, through the County Offices on Aging by trained, commission-free counselors. Statewide helpline: 1-800-792-8820. Counselors take no commissions and sell nothing. Great for one-off enrollment questions; we point our own members there during Open Enrollment.

PAAD, Senior Gold, Extra Help, and the Medicare Savings Programs

Unlike many states, New Jersey runs its own prescription programs: PAAD (Pharmaceutical Assistance to the Aged and Disabled) caps covered drugs at $5 generic and $7 brand for eligible residents, and Senior Gold pays half of drug costs for those a step above the PAAD income line. On top of that, many New Jerseyans qualify for federal Extra Help (the Part D Low-Income Subsidy) but never enroll, and all four Medicare Savings Programs automatically grant it. The Division of Aging Services runs the Medicare Savings Programs (QMB, SLMB, QI) to help cover Part B premiums and cost-sharing, and New Jersey applies both an income and an asset test to them. PAAD, Senior Gold, and the Medicare Savings Programs all share one application: NJSave (njsave.org), or call 1-800-792-9745. Screening for every one of these is standard advocate work, and most eligible seniors never claim them.

Personal Preference Program, MLTSS, and PACE: New Jersey's long-term care and paid family caregiving

New Jersey delivers Medicaid long-term care through Managed Long Term Services and Supports (MLTSS) under NJ FamilyCare. Its self-directed Personal Preference Program (PPP) gives an eligible person a personal-care budget and lets them hire a family caregiver, an adult child, another relative, a friend, or even a spouse, directly to provide care so they can stay home. New Jersey also operates PACE (the Program of All-Inclusive Care for the Elderly) for adults 55+ who need a nursing-facility level of care, now available in all 21 counties. These are NJ FamilyCare programs; for dual-eligible families we handle the Medicare side while you run the caregiving.
